Medico-legal Autopsy in Evidencing of Homicide: Issues and Challenges

Abstract


The project attempts to study issues and challenges that arise during a medico-legal autopsy and the consequential medical evidence by post-mortem surgeon in court of law. The research methodology which has been used is doctrinal in nature. Primary and secondary sources have been used in the study. The primary data has been collected from the judgments of Supreme Court, High courts, various enacted laws and reports of the Law Commission of India. The secondary sources which have been used are books, commentaries, research papers, articles, etc. The purpose of this study is to examine the effective use of scientific advancement in the investigation of homicide and the issues and challenges that have arisen in an effective use of knowledge of medical sciences for the advancement of criminal justice. The present study is limited to culpable homicides amounting to murder.
